This seemingly permanent class of partisan bureaucrats — holdovers from the Obama–Biden years and deep state administrations before them — have festered in place across administrations, surviving presidents and feeding off power like leeches, draining the institution while weaponizing justice against Trump supporters.
Now, one of them — DOJ attorney and part-time playwright Siegmund F. Fuchs — has filed paperwork to dismiss the $100 million lawsuit brought by Proud Boys leaders, in yet another bid to shield the deep state from accountability for political persecution.

The lawsuit, filed by Enrique Tarrio and the so-called “Seditious Five,” charges that Biden’s DOJ engaged in “egregious and systemic abuse of the legal system” to silence political opponents. Proud Boys civil attorneys argue their clients were railroaded with inflated charges, deprived of due process, and sentenced to decades in prison before President Trump ultimately pardoned or commuted many of them earlier this year.
Yet the Department of Justice insists there was “no misconduct.”
That claim collapses under the weight of bombshell new revelations from the government’s own star witness.
Here is the Motion to Dismiss authored by Fuchs:
This motion goes to bat for Biden and Merrick Garland’s sadistic DOJ and justifies all their actions against Trump Supporters on J6.
Directly from the Fuch’s Department of Justice motion:
“Incontrovertible photo evidence of Nordean, Biggs, and Rehl (*Proud Boys) inside the Capitol building was also used to support their arrests and detentions… and while Tarrio was not at the Capitol on that day and the district court found there was no ‘smoking gun,’ the court considered Tarrio’s contrary arguments and still found the evidence of his involvement in a seditious conspiracy to be ‘very strong.’”
Star Witness Implodes Under Oath
Just days ago, Jeremy Bertino — the DOJ’s key witness — recanted his testimony, admitting under oath that FBI officials threatened him with 25 years in prison unless he lied on the stand.

Bertino further alleged that the DOJ and FBI conspired to construct a false narrative to guarantee convictions, and that FBI agent Nicole Miller, who still works at the Bureau, personally coached him into perjury during illegal, off-the-record meetings with Biden’s prosecutors.

Legal experts now believe the real purpose of convicting the Proud Boys was never about them, but about creating a direct link to President Trump — laying the groundwork for the regime’s dream scenario: charging Trump himself with “Seditious Conspiracy.”
Deep State Bureaucrats Still Pulling Strings
Despite President Trump’s pardons, Biden loyalists remain embedded inside the DOJ. Figures like prosecutor Joselyn Ballentine, who played a key role in the Proud Boys trial, still occupy powerful posts and continue to corrode the halls of justice. And FBI agent Nicole Miller — the FBI agent accused of coaching false testimony — is still on the Bureau’s payroll today.

Jason McCullough — the lead prosecutor who orchestrated the kangaroo court Proud Boys trial, paving the way to convict President Trump in his own J6 case — was quietly demoted to handling misdemeanors. Yet he’s still drawing a government paycheck, when in reality he arguably should be facing trial himself for prosecutorial misconduct and conspiracy with fellow prosecutor Joselyn Ballentine and FBI agent Nicole Miller, who allegedly together coached witnesses, coerced testimony, and deprived Trump supporters of their constitutional rights.
The Real Conspiracy?
The DOJ is asking a federal judge to throw out the Proud Boys’ lawsuit, but the contradictions are glaring. How can the Department claim there was no misconduct when its own star witness admits to FBI coercion — and when the entire case appears to have been manufactured to target Trump himself?
As more Americans demand accountability for Fuchs, Miller, Ballentine, and the rest of the Biden-era operatives still clinging to power, one truth stands out: the fight for justice after January 6th is far from over.
Possible Charges Against McCullough, Ballentine, and Miller
Count I – Conspiracy to Deprive Rights (18 U.S.C. § 241)
McCullough, Ballentine, and Miller allegedly conspired to deny Proud Boys defendants their constitutional rights to due process and a fair trial, by fabricating a narrative designed to secure guilty verdicts for political purposes.
Count II – Obstruction of Justice (18 U.S.C. § 1503, § 1512)
The trio is accused of obstructing justice by coercing false testimony, concealing exculpatory evidence, and presenting perjured witness statements to the court.
Count III – Subornation of Perjury (18 U.S.C. § 1622)
By threatening Jeremy Bertino with a 25-year sentence unless he complied, prosecutors and FBI agents effectively solicited and suborned perjury.
Count IV – Prosecutorial Misconduct / Malfeasance in Office
McCullough and Ballentine abused their official powers, turning the Proud Boys trial into a political showpiece — a kangaroo court engineered to build a false precedent against President Trump.
Count V – Conspiracy to Defraud the United States (18 U.S.C. § 371)
By coordinating fabricated prosecutions, the actors deprived not only the defendants but the American people of honest government services and the lawful administration of justice.
Fuchs the Playwright
And here’s the kicker: the DOJ’s bid to bury the Proud Boys’ lawsuit is being led by Siegmund F. Fuchs — a government attorney who moonlights as a playwright.
His most recent work, “In the Closet,” wasn’t exactly a Broadway smash. Critics panned it as “a faux Frank Capra-esque gay version of It’s a Wonderful Life, full of crude jokes, predictable punchlines, and a maudlin finish.” One reviewer even compared a bizarre gang-rape subplot to “a Reefer Madness-style propaganda flick, Homos Gone Mad!!”
Now this same man, whose stage plays flop with audiences, is asking a federal judge to believe his Motion to Dismiss. If his legal work is anything like his theater work, it deserves the same reviews: poor.
And when will Nicolę Miller, Jocelyn Ballentine and Jason McCullough be held accountable and tried in a court of law?
